Widmer attorney petitions release from prison
WARREN COUNTY, Ohio (WKRC) -- The attorney for convicted killer Ryan Widmer is petitioning the federal court in Dayton, asking for his release from state prison.
The petition claims there were several things wrong with his conviction for murdering his wife Sarah. She was found dead in their Hamilton Township him in 2008. During his third trial, the jury convicted him of murder. Widmer was sentenced to 15 years to life in prison in 2011.
The petition claims several problems with his conviction, in an effort to get him released. Among them, the defense should have been able to question lead investigator, Lt. Jeff Braley, about the false information on his application to become a Hamilton Township officer. Braley has since resigned.
Widmer's attorney also claims the bathtub that was brought into the courtroom, should not been allowed in as evidence. His attorneys say the search warrant for the home did not cover the tub.
The petition also argues that the state's expert witnesses testified beyond their expertise. It also claims the jury should have had the opportunity to consider lesser charges such as manslaughter or reckless homicide.
Widmer's attorneys have used all these arguments during the appeals process. Various courts have rejected them all.
