Gay Couple Puts Marriage Case Before Local Judge
A gay couple in Ohio is hoping a US District court in Cincinnati will force the state to recognize their marriage.
Jim Obergefell and John Arthur were married in Mayland which permits same-sex marriage. Ohio does not.
The couple says they decided to file the lawsuit because Arthur has ALS and they wish for his death certificate to reflect his status as married.
The couple argues that the law treats opposite sex couples and same sex couples differently. For example, first cousins cannot marry in Ohio. But if they marry in another state where their union is legal, Ohio will recognize their out-of-state marriage as valid.
The case is pending before US District Court Judge Timothy Black.
