(CBS News) The ruddy-cheeked, camouflage-clad boy in the photo smiles out from behind a pair of glasses, proudly holding a gun his father gave him as a present for his upcoming 11th birthday.

The weapon in the photo, posted by his dad on Facebook, resembles a military-style assault rifle but, his father says, is actually just a .22-caliber copy. And that, the family believes, is why child welfare case workers and police officers visited the home in Carneys Point last Friday and asked to see his guns.

New Jersey's Department of Children and Families declined to comment specifically on the case but says it often follows up on tips.

The family and an attorney say father Shawn Moore's Second Amendment rights to bear arms were threatened in a state that already has some of the nation's strictest gun laws and is considering strengthening them after December's schoolhouse massacre in Connecticut.

In this case, the family believes someone called New Jersey's anonymous child abuse hotline.

Shawn Moore said he gave his son Josh the gun as a present to use on hunting trips. The elder Moore was at a friend's house when his wife called, saying state child welfare investigators, along with four local police officers, were at the house, asking to inspect the family's guns.

Moore said he called his lawyer Evan Nappen, who specializes in Second Amendment cases, and had him on speakerphone as he arrived at his house in Carneys Point, just across the Delaware River from Wilmington, Del. "They said they wanted to see into my safe and see if my guns were registered," Moore said. "I said no; in New Jersey, your guns don't have to be registered with the state; it's voluntary. I knew once I opened that safe, there was no going back."

With the lawyer listening in on the phone, Moore said he asked the investigators and police officers whether they had a warrant to search his home. When they said no, he asked them to leave. One of the child welfare officials would not identify herself when Moore asked for her name, he said. The agents and the police officers left, and nothing has happened since, he said. "I don't like what happened," he said. "You're not even safe in your own house. If they can just show up at any time and make you open safes and go through your house, that's not freedom; it's like tyranny."

State child welfare spokeswoman Kristine Brown said that when it receives a report of suspected abuse or neglect, it assigns a caseworker to follow up. She said law enforcement officers are asked to accompany caseworkers only if the caseworkers feel their safety could be compromised. "It's the caseworker's call," she said. "It is important to note the way an investigation begins is through the child abuse hotline. Someone has to call to let us know there is a concern."

Carneys Point Police Chief Robert DiGregorio did not answer a call late Tuesday to his office.

People need to mind their own business!!! For those "city folk" it is a rite of passage for a boy to own a .22 or a BB gun! I have grow up all my life with guns in my parents home. My brother and I knew what they were and what they were for. Hunting and sport shooting. We were taught what they were for and how they were to be used. Problem is the low life's who go out and kill innocent people with a gun have no idea what do actually do with one other then point it at someone, it makes them feel so important. People need to get a grip! I don't see anyone throwing a fit about knives...they are a deadly weapon as well! The mindless people who go on shooting sprees do not represent the nation as a whole when it comes to guns. Yes it is a sad thing, however because a few don't know how to act in society doesn't not mean the rest should suffer. I am sick of having to pay for what other people do, although it seems like the American way lately. Kudos to this dad for teaching his son the difference between the wrong way and the right way to use a firearm! Now that child welfare has been involved this man and his family will be under their microscope for every little thing. They need to investigate a child who actually is in danger

I have plenty of pictures of me holding firearms when I was young. Look at this picture. Muzzle in a safe direction, finger off the trigger. better safety than I have seen from other adults. This country is coming to a sorry state. and that greatly saddens me. This is not the america I grew up with

I don't blame the welfare worker nor the police. They were merely following up on a report. When they get a call of this nature they never know what to expect. The story says they left when they were asked to and never returned. That in itself shows they were satisfied with what they heard. What if they had not responded and something went drastically wrong, everybody would be on them for not doing their job. Nope, I don't blame them, Now for the nosey idiot that reported it, he/she should check further before picking up the phone.

Why are half of you stuck on the caliber of the riffle? It doesn’t matter if it’s a .22 or a .223, so what if the kid has a .576 nato? It doesn’t matter if these folks live in the city or in the country. The law is the law and none have been broken. And to the A-hole who mentioned something about this kid snapping one day and gunning down a bunch of people, you are about as ignorant as they come buddy!

I think that its great that this father is teaching his child about guns. No, I don't think that this kid will snap and go on a killing spree. Education is the first step to preventing a lot of the crap that goes on. It greatly upsets me that someone called this hotline and reported the father for this. Obviously, the person that reported them was not properly educated in firearms; and this is an outrageous attempt on our second amendment rights.

This is the dumbest thing Ive seen in a while...There is nothing wrong with this picture or any reason to be concerned over this...People need to stop crying wolf over NOTHING... @djs6865 and for your comment about this kid growing up to snap is the du mbest thing Ive read on these comments...What would give your that impression is it the disease of liberalism thatyousuffer from...We dont need to discourage people from playing with guns mabey we should teach the value of LIFE and the proper way to keep and use firearms...Grow up

With all the school shootings and 'spree shootings' lately, I think people have a right to be concerned about this photo. This child could possibly grow up to 'snap' and shoot other people to death. I am not against people owning guns, but at the same time, all of us as a nation, need to do what we can to discourage kids from playing with guns. Not encourage it. Too many innocent people are dying in this country from people that aren't responsible enough with guns. I'm sure most of you would feel the same way, if someone in your family was killed in a senseless shooting.

Child care can be a great blessing but did not follow the rules on this and will cost themselves a big law suit. Know what the law is before you think you can enforce it in an unlawful manner. The gun looks menacing but is a replica that fires .22 ammo. The way this young man holds the gun shows he is well taught. I am proud of this young man and the Child Welfare people should be able to see quality parenting.
