Man Attempts to Overturn Death Sentence for the Third Time

BUTLER COUNTY, Ohio (WKRC) -- A man convicted of killing a Butler County woman tries for a third time to have his death sentence overturned.

The Ohio Supreme Court will decide Von Clark Davis' latest appeal.  He was sentenced to die for the shooting death of Suzette Butler in 1983.

At the time Davis was on parole after spending ten years in prison for killing his wife.  His sentence has already been overturned twice.  But in 2009, a three judge panel in Butler County reinstated the death sentence.

His lawyers are trying to have that order vacated on grounds that a jury should have re-sentenced him, not the panel of judges. Man Attempts to Overturn Death Sentence for the Third Time
