Most state laws on workers' compensation allow an injured worker to select his or her own doctor in certain circumstances. For instance, many states permit the employees to choose their own doctor when the employer does not provide or post a list of doctors at the job site. Under that circumstance, the employees are allowed to seek their own medical care at the expense of the employer. Many states will provide a procedure to follow when selecting medical care different from what the employer provides, with the approval of the State Workers' Compensation Board. There are a few states that always allow the employees to choose their own medical care and treatment. These states also provide for independent medical examinations at the request of either the employee or the employer. It is important that you understand the specific requirements of the workers' compensation law in the state where you work.
