Under the Workers' Compensation Law, you are not required to settle your claim if you do not want to do so. Your employer is required to provide you with the benefits required by law if your claim is accepted, but this does not include a forced settlement of your claim. If your claim has been accepted, but you believe you would not be receiving the correct amount of compensation, it may not be in your best interest to settle your claim. If you are uncertain as to whether or not you want to settle your claim, you should consider hiring a workers' compensation attorney. You have the right to be represented by an attorney, whose fees are generally set by law as a percentage of the benefits you receive. If you consult an attorney, it is important that you discuss and understand the fee involved. Your attorney can assist you in determining whether or not a settlement is in your best interest.
