Am I entitled to my salary while off work?
Under many state workers' compensation laws, injured employees are not entitled to the entire amount of their regular salary while off work due to a work-related accident.
Benefits after I return to work
After you have returned to work following a work-related injury, state law may authorize payment of additional income benefits under certain circumstances.
Benefits if completely off work
Most state workers' compensation laws provide for important benefits including medical expenses, disability payments, and in some cases, vocation rehabilitation costs.
Can I recover for all my lost wages?
Under workers' compensation laws, many states limit the right to recovery of an injured worker. An injured worker generally has a right to recover for loss of income.
Can I recover pain and suffering?
Many state workers' compensation laws do not allow an injured employee to recover for pain and suffering resulting from a work-related injury. As an injured employee, you are, however, entitled to certain benefits specified under each state's law.
How do I know if I am receiving all my benefits?
Many state workers' compensation laws provide for various benefits which generally fall into three main categories. These categories are income benefits, medical care expenses and vocational rehabilitation costs.
Value of your work-related claim
The value of your claim, if you have been injured in the course of your employment, is defined by the workers' compensation law of the state in which you are employed.
What if I have a permanent injury?
After your doctor determines that you have reached maximum recovery, he or she may find that you have a permanent injury. If the doctor finds that you have some permanent disability, you may be entitled to additional workers' compensation benefits.
When do my benefits start?
Many state workers' compensation laws provide a certain waiting period before an injured employee is entitled to receive any income benefits. If you are injured and return to work within a certain period of time, or you are disabled and unable to return to work past the specified waiting period, then you should receive payments for lost income from the date of your disabling injury.
