Dealing with an insurance adjuster
If you're involved in an automobile or motorcycle accident, immediately inform your insurance company, who will let you know what paperwork is required.
Defective highway design
If you're involved in an automobile or motorcycle accident that you believe was caused by defects in the design of the road or highway, you might be able to obtain compensation.
DUI, DWI, OUI
Driving under the influence of drugs or alcohol is a crime in every state, whether it's called driving under the influence, or DUI (D-U-I); driving while intoxicated, or DWI (D-W-I); or operating under the influence, or OUI (O-U-I).
If the other driver was intoxicated
If you're injured in an accident in which the other driver was intoxicated, you need evidence of this fact. Generally, the police obtain this evidence as part of the crime investigation, but whether or not the police are involved, you need the other driver's name and insurance details, and you should try to obtain this information at the scene of the accident, if possible.
Lack of insurance
If you're injured in an accident, the insurance company of the driver at fault usually pays your medical and other expenses, as proposed by the insurance adjuster assigned to the case.
Protecting yourself in an automobile accident
If you've been involved in an automobile accident and there's any damage or injury involved, there are a few important pieces of information you should obtain before leaving the scene.
Rental cars
If you've been involved in an auto accident, you can rent a vehicle to use while repairs are made to your car. In this case, the liable party's insurance company covers the expenses of the rental car.
Repairs
If you're involved in an accident in which your vehicle is damaged by another vehicle, the insurance company of the driver at fault is liable to compensate you for a complete restoration of your vehicle to the general condition it was in prior to the accident.
Substitution of collateral
If your car is damaged beyond repair in an accident, the insurance company of the liable party generally offers to compensate you according to the fair market value of the vehicle.
Symptoms of a head injury
Head injuries always have the potential to be serious, even if there's no apparent wound (woond) or fracture. These so-called 'closed head' injuries can be extremely dangerous since the symptoms don't always appear at once.
Value of your wrecked motorcycle
If your motorcycle is wrecked in an accident, the compensation you receive depends on the type of insurance coverage you have and on the bike's estimated market value.
What if my car is totaled?
If your car is totaled in an accident, it will probably be towed from the scene and possibly held temporarily for investigation before being sent to a wrecker's yard.
What to do after a car accident
If you're involved in a car accident resulting in any vehicle damage or injury to any person, the police should be called to the scene. Under no circumstances should you leave the scene of an accident involving any injury until the police have taken your name and other personal information.
Who pays for lost wages?
In theory, if you lose wages as the result of being involved in a traffic accident, the insurance company of the driver at fault is liable to compensate you.
Who pays the medical bills?
Normally, if you're injured in a vehicle accident, the insurance company of the driver at fault is liable for all compensation, including all your medical bills and costs of therapy.
