False statements
The Fair Debt Collection Practices Act is a set of rules and guidelines that creditors and collection agents must follow when seeking to collect debts.
Prohibited practices
Though debt collectors may contact you in person or by mail, telephone, telegram, or fax, certain practices are prohibited under the Fair Debt Collection Act.
Stopping calls from debt collectors
By law, you can stop debt collector calls by writing a letter to the collector instructing them to quit contacting you. After the collector receives your letter, he or she may not contact you again except to say that communication will cease or to notify you that the collector or creditor intends to take legal action.
Unfair practices
When a debt is being collected, certain practices are considered unfair according to the Fair Debt Collection Practices Act. For example, collectors are not allowed to collect any amount larger than your debt, unless your state law allows this type of additional charge.
What is a debt collector?
By definition, a debt collector is anyone who collects debts owed to others on a regular basis. There are three major types of debt collectors: in-house collectors, agency collectors, and attorney collectors.
