If you signed up for satellite television service but are unable to receive it at your home, should you still have to pay? That's what a local woman says has happened to her and she feels it's not right.
Local 12 Troubleshooter Howard Ain says when Dee Hayes signed up for satellite television service with Dish Network everything was fine. She and her husband were living in Florence last year and got a great picture.
Things started to go wrong when they moved to Union. "They gave us a 2 year contract. We moved about 8 to 9 months later and we told them our new address. We said come on out and give us the service. They said we can't give you the line of service, you're not in the line of sight."
The porch on Hayes condo faces the wrong direction for seeing the satellite. "The guy that came out said I can't get you the sight. He called the supervisor. The supervisor came out and said there's no way we can't get you a line of sight. And we said what's that going to do to the contract. He said they can't charge you for something they can't provide you service for."
But the folks at Dish Network didn't agree. "They said sorry you can't. You're still going to have to pay out that contract. But I said if you can't provide me the service why should I pay."
Hayes says despite numerous calls to many people at Dish Network she was charged $127 as a cancellation fee. Under the terms and conditions of the Dish Network agreement it says its ok to move but you're still bound by the terms and conditions of this agreement. Hayes says that's fine but it really shouldn't apply to her. "I'd just like to get my $127 back and I'm sure there's other people out there besides me and I think Dish could reimburse everybody else that has money coming back to them."
So I contacted Dish Network which said it takes all complaints on a case by case basis. In this situation, they said they apologize for any inconvenience to Hayes. Once they were made aware of the issue, they immediately contacted her and have now decided to refund all her cancellation charges.
