The Hamilton County Prosecutor's Office has dismissed charges against a ten year old boy who allegedly brought a BB gun to an Elmwood Place school. The judge declared the boy incompetent to stand trial due to his young age, saying he did not understand the legal process enough to contribute to his defense.

Elmwood Place Police say the boy showed a BB gun to five fellow students while in the bathroom in April. The tip of the BB gun was broken off, but one of the students told police the boy with the gun threatened to shoot him if he told anyone that the gun was in the school. One of the students immediately told school officials, who called police.

The boy was facing a charge of inducing panic.

If that "broken" "tip missing" "BB gun" was pulled on a cop, the kid might be dead today. For those of you acting like this isn't serious, what if? What if it was a "real gun? What if someones child, God forbid yours, was injured or killed? Isn't it better to be safe than sorry, or do you think rules should be bent or ignored to protect the guilty? The ACLU does that for you. Incorporate self defense into that lame CPS physical education program so kids can learn to disarm thugs regardless of their age.

There is a big difference between a GUN an BB gun, yes the boy needs to be punished but really.... You don't have to leave out key words to make the story more attractive to read. 10yr old-school- *BB Gun* is good enough. "10-Year-Old Elmwood Place Student Arrested in Gun Incident" looks like the person that wrote this is making it bigger than what it is. Poor news in my book.

I would like to commend the young man who under duress of threat still notified authorities at the school. There is a good kid. This is a kid who knows the difference between right and wrong. Kid you have my thanks. You are a brave young man to stand up to a threat like that. Three cheers!

Anyone who was induced with panic from seeing a BB gun needs to be put in a strait jacket and sent to the funny farm.
